Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy supplements our Privacy Policy and applies to “consumer health data” as defined by the Washington My Health My Data Act, Nevada Senate Bill 370, and similar laws (such as the Connecticut Data Privacy Act), collected by Iniyara Technologies LLC (“Iniyara”, “we”, “us”) through the My Day Compass Services. If there is a conflict between this policy and the Privacy Policy regarding consumer health data, this policy controls.

Summary. My Day Compass is a planning tool, not a health service. We do not ask for health information. If you choose to write health-related plans, such as appointments, medication reminders or fitness routines, we use that content only to provide the Services you asked for. We never sell it, use it for advertising, or share it except as described below.

1. Consumer health data we collect

We do not request consumer health data. However, because you can record any information you choose, the following may constitute consumer health data under applicable law when you include it in your content:

• tasks, notes, events or reminders that refer to health conditions, treatments, appointments with health care providers, medications, or physical or mental wellness;
• routines, categories or goals related to fitness, exercise, sleep, diet or other wellness activities; and
• information you import from calendars or other services that contains any of the above.

We do not collect biometric data, genetic data, precise geolocation, or data from health devices or health platforms such as Apple Health or Google Fit.

2. Sources

Consumer health data is collected from you, when you create or import content, and from other users only if they choose to share content with you.

3. Purposes and how we use it

We collect and use consumer health data only as necessary to provide the Services you have requested: to store, synchronize, organize and display your content, schedule the reminders you set, and share it with people you choose. We do not use it to infer health conditions, to build profiles, for advertising or marketing, or to train artificial intelligence models. If we ever wish to collect or use consumer health data for any other purpose, we will first obtain your separate, express consent.

4. Sharing

We share consumer health data only:

• with people you choose to share your content with, at the level of access you grant;
• with our processors that host, store, back up and secure the Services on our behalf (cloud infrastructure, authentication and backup providers), under contracts that restrict their use of it to providing services to us; and
• where required by law, or with your consent.

We do not sell consumer health data, and we will not do so without a valid authorization from you as required by law.

5. Your rights

Subject to applicable law, you have the right to:

• confirm whether we collect, share or sell your consumer health data, and access that data, including a list of all third parties and affiliates with which we have shared it;
• withdraw your consent to our collection and sharing of your consumer health data, which you can do by deleting the relevant content or your account;
• have your consumer health data deleted, including from our processors’ systems; and
• not be discriminated against for exercising these rights.

You can delete content at any time in the app, and delete your account in the app or at app.mydaycompass.com/delete-account. To make any other request, email privacy@iniyara.com with the subject “Consumer health data request” from the email address associated with your account. We will verify your identity and respond within 45 days, which may be extended by a further 45 days where reasonably necessary, in which case we will tell you. If we decline your request, you may appeal by replying to our decision; if your appeal is denied, you may contact the Washington State Attorney General or the attorney general of your state.

6. Security and geofencing

We protect consumer health data with the safeguards described in our Privacy Policy and restrict access to personnel who need it. We do not use geofencing around any health care facility.
